Sometimes, life changes - and so do decisions. If you’ve filed for divorce but now wish to withdraw your application, the process is called a Notice of Discontinuance. 📝 This halts your case or part of it, and can be submitted through the Commonwealth Courts Portal or directly via the Federal Circuit and Family Court of Australia.

👉 However, it’s important to note that the other party may still pursue their own orders, even after you’ve filed your notice.

If you’ve been married less than two years, you’ll need to attend counselling sessions before proceeding with or withdrawing a divorce. And if there are children under 18, the court must be satisfied that suitable arrangements are in place for their care and wellbeing. 👨‍👩‍👧‍👦💞
